Short answer: CBD is not simply legal or illegal in the Netherlands. The rules sit in a grey area. The Opium Act still controls the cannabis plant, Dutch practice tolerates CBD products with at most 0.05% THC, and the EU Court of Justice has ruled that CBD is not a narcotic drug. This guide explains each part, links the sources we used and says what we could not check. Our check was made on 20 October 2026.
The Opium Act and the cannabis plant
The Netherlands regulates drugs through the Opium Act (Opiumwet). A Dutch legal article on CBD and food law says that only CBD with a purity of 99.95% falls outside the Act. The cannabis plant and its parts remain controlled, and the same article says this makes natural CBD production in the Netherlands impossible. This is one reason the rules feel confusing: the product and the plant it comes from fall under different parts of the law.
The 0.05% THC limit
The limit you will see most often is 0.05% THC. The Dutch legal article describes it as the maximum THC content the Netherlands permits in CBD products. We could not read the rule in full, so the figure rests on practice and legal commentary rather than on a single text we could check.
Because of this, check the THC figure on the lab report for each batch before you buy or travel with a product.

The EU ruling: CBD is not a narcotic
On 19 November 2020 the Court of Justice of the European Union ruled in Case C-663/18 (the Kanavape case) that CBD is not a narcotic drug, because it is not listed in the UN drug conventions. The court also ruled that a member state may not prohibit the marketing of CBD lawfully produced in another member state when it is extracted from the whole cannabis plant, not only from its fibre and seeds.

The ruling is about the free movement of goods in the EU. It does not settle every Dutch rule on the plant or on novel food.

Novel food: the open question
Under EU rules, CBD extracts are classed as novel foods, which need authorisation from the European Commission before they can be marketed as food. The Dutch legal article says several companies have submitted applications, and that the evaluations were paused pending legal clarity. Source: vmt.nl.
We could not confirm the current status of these applications in our check.
What this means for buyers and visitors
- Read the lab report. Look for the THC figure and the date of testing, and check that the batch matches the product you are buying.
- Do not confuse CBD shops with coffeeshops. Coffeeshops sell cannabis under the Dutch tolerance policy, which is a separate system. Our Amsterdam coffeeshop guide explains those rules.
- Check the official source before you buy or travel. The Dutch food and consumer product authority is the NVWA.
What we could not check
- The NVWA’s current guidance on CBD. The page we tried returned a 404 error, so we could not read it.
- An official government text on the current THC limit. Our searches found only industry and legal commentary.
- The current status of CBD novel food applications. We could not confirm whether any has been authorised.
Frequently asked questions
Is CBD legal in the Netherlands?
It is a grey area rather than a clear yes or no. Only CBD with 99.95% purity falls outside the Opium Act, the cannabis plant stays controlled, and Dutch practice tolerates a THC content of at most 0.05%.
What THC limit applies to CBD in the Netherlands?
The figure most often cited is 0.05%. Dutch legal commentary describes it as the maximum THC content the Netherlands permits in CBD products.
Did the EU court make CBD legal across the EU?
No. In 2020 the court ruled that CBD is not a narcotic drug and that a member state may not block CBD lawfully produced in another member state. It did not settle every national rule.
Are CBD shops and coffeeshops the same?
No. Coffeeshops operate under the Dutch tolerance policy for cannabis. Our Amsterdam coffeeshop guide explains those rules.
